Sobre la subsanació de la legitimació del president per actuar en nom de la comunitat de propietaris quan no hi ha acord previ de la comunitat de propietaris
Segons la Interlocutòria 66/2017 de l’Audiència Provincial de Girona de 13/03/2017 sobre la legitimació del president per actuar en nom de la comunitat de propietaris quan no hi hagi un previ acord pres per la comunitat que li legitimi, aquesta manca de legitimació es podrà subsanar posteriorment si en acord de junta de propietaris es ratifica o convalida l’actuació feta pel president.Dit en altres paraules, segons aquesta resolució, quan el president exercici una acció en nom de la comunitat de propietaris per la que en aquell moment no tingui legitimació formal de la junta de propietaris, es podrà esmenar posteriorment aquesta manca de legitimació mitjançant la convalidació o ratificació de l’actuació feta pel president per part de la Junta de Propietaris i fent-hi expressa menció en l’acta de la junta que en resulti.En tot cas, al respecte d’aquestes actuacions serà necessari consultar amb el seu advocat.
