What is a Certificate of Occupancy?

A Certificate of Occupancy is an administrative document which certifies that a property complies with the basic conditions of occupancy foreseen by the current legislation and is apt to be used as a residence.

What is the format like?

A Certificate of Occupancy does not state the name of the owner, as its function is to certify the objective occupancy conditions of a property, regardless of its owners or occupants.

When do I need a Certificate of Occupancy?

A Certificate of Occupancy is necessary in order to sell, rent or grant use of a property, whether it is a first conveyance or not (except in cases of exoneration foreseen by the current legislation). It is also required to hire electricity, water or gas supplies, telecommunications and other services.

Therefore, garages, for instance, do not require a Certificate of Occupancy.

How can I find out if my property has a Certificate of Occupancy?

If my property does not have a Certificate of Occupancy, must I obtain it?

If you wish to convey, sell, rent or grant use of your property you must obtain the certificate.

Does the certificate expire?

Generally, the certificate is valid for 15 years. But in the case of new properties, it can be valid for 25 years.
